CJIS-Compliant Digital Evidence Sharing

The sheer volume of digital multimedia evidence (DME) landing on law enforcement agencies today is staggering. Between body-worn cameras (BWCs), dash cams, private security feeds, cell phone extractions, and ring doorbells, investigators are swimming in files.

But collecting the data is only half the battle. The real headache begins when it’s time to move that evidence out of the precinct and onto a prosecutor’s desk.

Under the FBI’s CJIS guidelines, digital evidence often contains or is connected to Criminal Justice Information (CJI). If an agency relies on unmanaged workarounds or basic cloud folders to share these assets, it can introduce serious compliance risks. In addition to complicating upcoming agency audits, these insecure transmission methods can make it difficult to establish a trackable, defensible chain of custody if challenged by defense counsel in court.

What Is CJIS-Compliant Digital Evidence Sharing?

CJIS-compliant digital evidence sharing is the transmission of digital assets between authorized criminal justice agencies (such as law enforcement and prosecutorial offices) using technical, physical, and administrative controls that support alignment with the FBI CJIS Security Policy. Because compliance is a shared responsibility, it requires a combination of vendor platform controls, agency policy, user training, and strict access administration to maintain security across the digital evidence lifecycle.

It is vital to understand that CJIS compliance is not a static certificate, an off-the-shelf software stamp, or a simple checkbox on a commercial vendor's marketing page. Rather, it represents an overarching, shared responsibility model encompassing the software application, the cloud hosting provider, the local agency infrastructure, and the operational habits of the personnel handling the data.

To achieve a compliant posture during the digital evidence sharing lifecycle, the underlying technology must proactively protect files across three core operational states:

1. Data in Transit

When digital evidence containing or connected to Criminal Justice Information (CJI) is transmitted over public or unmanaged networks, such as transferring electronic case files from a municipal police department to a county prosecutor's office, the data must be protected using validated cryptographic modules.

The FBI CJIS Security Policy requires that encryption utilized outside the boundary of a physically secure location employ a FIPS-validated cryptographic module and meet minimum cipher key strength benchmarks (such as AES 128-bit or higher). Implementing these certified modules helps prevent unauthorized access and ensures the confidentiality of data packets during network transmission.

2. Data at Rest

Once digital evidence is stored within a DEMS platform, it must remain protected against unauthorized access, duplication, or modification. Under the CJIS Security Policy, data at rest must be secured using FIPS-validated cryptographic modules when stored outside a physically secure location.

Furthermore, cloud hosting environments used for criminal justice data must align with strict data sovereignty and personnel security controls. This includes ensuring data residency requirements are met and verifying that cloud provider personnel with potential administrative access to unencrypted data have undergone required background checks and security training, established through a signed CJIS Security Addendum.

3. Data in Use

Conformity does not stop simply by virtue of opening a document. No matter if it's an investigator watching a clip or an attorney going through a report, there has to be proper identification and confirmation that the individual has the right to access it. It takes exacting measures in the background to determine the user's level of access, such as the ability to distribute and modify the document or only look at it in read-only mode.

Where Digital Evidence Sharing Creates CJIS Risk

In spite of the mandates set out in the policies for national security, many public safety organizations still continue working using fragmented networks and outdated methods. Because of the strict timeframes, huge number of cases, and limits of the IT systems, employees tend to use convenient consumer-level or enterprise-level alternatives.

While these methods may successfully move a file from Point A to Point B, they create severe compliance gaps that defense attorneys can target during discovery motions.

The Limitation of Email Attachments

The most common, default method for sharing text documents, crime scene photos, and short audio snippets is standard agency email. However, email is fundamentally unsuited for secure digital evidence management. From a purely technical perspective, municipal and county email servers enforce strict file size caps, typically limiting attachments to 20MB or 25MB. To bypass email file limits, some well-meaning investigators resort to consumer or commercial cloud storage solutions like standard Dropbox, Google Drive, OneDrive, or Box accounts. While these platforms offer high-speed transfers and massive storage capacities, their basic configurations do not conform to public safety standards.

Commercial cloud links do not force multi-factor authentication (MFA) on external third-party recipients by default, meaning anyone who gains access to the shared link can open the sensitive files. Furthermore, consumer clouds lack the granular, user-level audit controls required to build a courtroom-ready history of asset interaction, and their corporate data centers often fail to sign mandatory CJIS Security Addendums.

The Danger of Physical USBs and DVDs

For decades, burning a disc or loading a thumb drive was the standard way to package a case for the DA. But physical media is an operational liability. Drives get lost, broken, or left in unsecure vehicles. Worse, they leave a black hole in your chain of custody. Once a USB leaves an officer's hands, there is zero electronic record tracking who plugged it in, who copied it, or who looked at it.

The Risk of Non-Compliant Cloud Hosting

Even when agencies adopt digital sharing tools, they often overlook where the underlying data actually resides. Standard corporate cloud configurations share physical server resources across thousands of commercial businesses.
