What Is Giglio Material?

Giglio material is evidence that could be used to challenge the credibility of a prosecution witness, and prosecutors must disclose it to the defense. The rule comes from the 1972 U.S. Supreme Court decision in Giglio v. United States. It applies to any witness the state plans to call, including police officers, informants, and expert witnesses.

The giglio material definition is broader than many people expect. It covers anything that gives the defense a fair chance to question whether a witness is telling the truth. Common examples include:

  • Plea deals, immunity, or other promises made to a witness in exchange for testimony
  • Payments or benefits given to an informant
  • Prior inconsistent statements
  • Criminal history or past acts of dishonesty
  • Sustained findings of untruthfulness in a personnel record, when the witness is an officer

A giglio disclosure is the formal step of turning that information over. Missing it can put a conviction at risk, even when the omission was unintentional.

Giglio vs Brady

The two rules are closely linked, and offices often refer to them together. The short version is that Brady covers evidence that points away from guilt, while Giglio covers evidence that undermines a witness. Some material fits both.

Courts treat both as part of the prosecution's constitutional duty to disclose, so the practical difference matters less than getting the disclosure made on time.

Officer Credibility and Brady Lists

Much of the public interest in Giglio comes from how it applies to law enforcement. When an officer's credibility has been seriously questioned, that information may need to be shared with the defense whenever the officer is a witness.

Many prosecutor's offices keep an internal record of officers with potential impeachment issues. These records are commonly called Brady lists, though they are often built around Giglio concerns. Names for them, criteria for inclusion, and review procedures differ widely from one jurisdiction to another, and state laws on access and confidentiality vary too.

An officer whose record raises credibility concerns is sometimes described as "Giglio impaired." That label is informal and has no single legal definition. Generally it means the officer's testimony may be difficult to rely on in court, which can affect how cases involving that officer are charged and tried.

How Offices Track It

Giglio obligations don't end once a piece of information is identified. Someone has to document it, connect it to the right cases, and confirm it reached the defense. Offices typically handle this by:

Logging potential impeachment material as it arrives from agencies and internal sources

Linking it to every open case involving the witness

Recording what was disclosed, to whom, and when

That last step is where an audit trail matters. A time-stamped record showing exactly what was shared and when gives an office solid proof that its disclosure duties were met.
