What Do Evidence Custodians Actually Do?

When people ask what evidence custodians do, the standard answer is usually some version of "they organize the evidence room." That undersells the job by a considerable margin. A property and evidence custodian holds one of the most critical operational positions in the criminal justice system, an objective guardian of legal integrity. Every piece of physical property and every byte of digital media tied to a criminal investigation must pass through their hands, receive their verification, and remain under their strict control until final legal disposition.

An investigator who misses a lead might stall a case. An evidence custodian who makes a systemic error in handling, tagging, or logging can collapse an entire prosecution in court. The scope runs from blood-stained clothing and seized firearms to multi-gigabyte body-worn camera files and mobile device extractions, anything that proves guilt or innocence, at every stage of its existence.

A Day in Intake

Intake is where the evidence lifecycle begins. On any given morning, an evidence custodian steps into the intake area to find temporary pass-through lockers filled with items submitted by patrol officers, detectives, and crime scene technicians during the previous shift.

The primary objective during intake is verification. A property and evidence custodian never assumes that incoming items are correctly packaged or cataloged. They independently inspect every submission against the submitting officer’s report:

Physical Inspection and Packaging

Custodians verify that bio-hazard material, such as dried blood samples, is contained in breathable packaging paper, guns are made safe and zip-tied, cash is counted twice with signatures from witnesses, and controlled substances are placed in tamper-resistant heat-sealed bags.

Barcode Assignment and Physical Staging

Once verified, physical evidence receives a unique barcode tracking number. The custodian records the artifact in the property management database and transfers it from the temporary intake lockers to long-term secure storage facilities like high-security vaults for money, fire-resistant vaults for firearms, or temperature-controlled vaults for biological materials.

Digital Media Ingestion

In the case of digital artifacts recorded onto tangible media (USB drives, SD cards, or optical discs), the custodian checks if the file format is the same as the one listed in the case file, conducts an antivirus scan on the file and computes a cryptographic hash of it.
Rigorous intake protocols are what keep mislabeled items, unsealed drug packaging, and corrupted digital drives out of the master inventory. Catching those problems at the door saves hundreds of hours of administrative corrections later.

Chain of Custody as Daily Work

Maintaining an unassailable chain of custody is not a passive responsibility; it is the core of evidence custodian daily tasks. Chain of custody represents the chronological, unbroken record of every individual who held, transferred, analyzed, or presented a piece of evidence in a case.

Throughout the day, custodians manage a constant stream of check-outs, transfers, and returns:

State Crime Lab Submissions

Detectives request transfers of DNA samples, ballistics, or latent prints to state forensic labs. The custodian logs the exact date, time, courier details, and purpose of release, updating the custodial ledger.

Courtroom Subpoenas

When a case goes to trial, custodians retrieve the physical items or digital exhibits, sign them out to the presenting officer or court officer, and track their return once proceedings conclude.

Prosecutorial Discovery

Custodians ensure that defense counsel and district attorneys receive verified, complete duplicates of digital evidence without ever risking the integrity of the original master item.
If defense counsel challenges an item's admissibility in court, the custodian is often called to testify. They must stand on the witness stand and confidently present custodial logs that account for every second the evidence remained in their vault.

Audits and Purges

An evidence vault that only accepts incoming property without releasing old assets will quickly experience an operational bottleneck. Effective evidence room management relies on two complementary administrative workflows: routine audits and systematic purges.

Inventory Audits

Audits ensure that every logged item physically or digitally matches its assigned location in the system. Custodians participate in three primary types of audits:

Daily/Weekly Spot-Checks

Random selection of barcoded bins or digital directories to verify locations and seal integrity.

Command Audits

Unannounced audits conducted by internal affairs or external supervisory boards, usually focusing on high-risk categories like cash, drugs, and firearms.

Annual Full Inventories

Comprehensive 100% accountings of every physical item and digital file stored within the agency's custody, typically executed prior to command changes.

Retention Execution and Purges

Purging property is one of the highest-risk evidence custodian duties. Destroying an item too early can result in a dismissed indictment or civil liability; holding onto items indefinitely leads to bloated storage facilities and unnecessary cloud storage costs.

Custodians systematically review active cases against statutory retention rules. When a case reaches final legal resolution (expiration of appeal windows, statute of limitations completion, or formal court authorization), the custodian initiates the disposition process:

Return to Lawful Owner

Unclaimed property, recovered stolen goods, or personal items taken during booking are prepped for owner notification and release.

Public Auction / Agency Retention

Non-contraband items suitable for public sale or conversion to agency use are processed according to local municipal codes.

Certified Destruction

Illegal narcotics, unclaimed firearms, biological hazards, and bio-contaminated clothing are logged, weighed, witnessed, and transported to specialized incinerators or melting facilities for certified destruction.

The Digital Shift

The nature of modern law enforcement has fundamentally expanded the evidence custodian job. Historically, an evidence room custodian spent 90% of their time moving physical boxes, organizing metal shelving, and filing paper logs. Today, the vast majority of new evidence generated by law enforcement agencies arrives in digital formats.

A single felony arrest can generate hundreds of gigabytes of data originating from:

Body-worn camera (BWC) recordings from multiple responding officers

Fleet dashcam footage and 911 dispatch audio calls

Automated license plate reader (ALPR) captures and CCTV surveillance feeds

Extraction dumps from cell phones, hard drives, and cloud accounts

Digital crime scene photographs and 3D spatial scans

This shift has created the specialized digital evidence custodian role. Instead of managing physical square footage, modern custodians must manage digital architecture, access permissions, security protocols, and cloud retention rules.
Operational Area Traditional Physical Custodian Modern Digital Custodian
Storage Asset Physical shelves, lockers, safes, and freezers CJIS-compliant cloud repositories and server vaults
Integrity Check Tamper-evident tape, physical locks, and wax seals SHA-256 cryptographic hashing and digital audit logs
Intake Method Physical pass-through lockers and paper logs Direct upload, automated CAD/RMS syncing, API ingestion
Discovery Handoff Burning DVDs, copying flash drives, physical couriers Secure, time-limited digital share links with tracking
Retention Execution Physical incineration, shredding, and return Automated cloud purge schedules and digital disposition logs
Without a specialized Digital Evidence Management System (DEMS), digital evidence creates new administrative bottlenecks. Custodians end up managing stacks of external hard drives, unindexed local servers, and manual cloud downloads. The modern DEMS allows for the consolidation of records about tangible as well as digital evidences in a single workspace, ensuring chain of custody standards remain equally stringent irrespective of whether the asset is a tangible handgun or a digital MP4 file.

Frequently Asked Questions

What do evidence custodians do on a daily basis?

Evidence custodians examine both physical and digital evidence that comes in on a daily basis, ensure their packaging and encryption, give storage locations, maintain chain of custody records for any transfer to the courtroom or laboratory, conduct inventory audits, and undertake court ordered destruction of property.

What qualifications are needed for an evidence custodian job?

To work as an evidence custodian, one is expected to have either a high school diploma and a degree in either criminal justice, business administration, or information technology. The skills needed include a keen eye for details, understanding of chain of custody laws, inventory database management experience, CJIS security requirements understanding, and certification from associations such as IAPE.

How does the digital evidence custodian role differ from managing physical evidence?

Unlike physical evidence management—which involves organizing warehouses, maintaining physical security, handling tamper-evident packaging, and managing shelf space—managing digital evidence focuses on cloud storage administration, integrity verification using cryptographic hashing (such as SHA-256), access management, redacting protected information, and automating digital retention schedules.

How do evidence custodians know when it is safe to purge evidence?

Evidence custodians monitor statutory retention schedules, which include state regulations and court orders. Custodians do not dispose of evidence on their own; rather, they assess case dispositions together with the prosecutor, investigators, and court clerks. Evidence custodians dispose of evidence after getting formal disposition authorization that states all time windows for trials, appeals, and post-convictions are over.

How do evidence custodians maintain a strict chain of custody for digital files?

Custodians ensure a digital chain of custody through digital evidence management systems. Once a file enters the system, it is automatically assigned a cryptographic hash to guarantee authenticity. The system then automatically logs every action performed on the file, including viewing, downloading, sharing, and redaction, along with the specific user credentials and an exact date and timestamp.
